By creating an account or using the Kuha service (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms constitute a legally binding agreement between you and Kuha ("we," "us," or "our").

You must be at least 18 years old to create an account. You are responsible for safeguarding your password and for all activities that occur under your account. You must notify us immediately of any breach of security or unauthorized use of your account.

Kuha provides a platform for users ("Owners") to create shared digital photo albums for events. Owners can bundle that grant varying levels of photo storage, quality, and feature access. Owners can then generate and share a unique link or QR code with their attendees ("Guests"), who may upload photos and send messages to the album without creating an account.

Your use of the Service involves uploading photos, messages, and other content ("Your Content"). You are solely responsible for Your Content.

a. Ownership of Content

You retain full ownership of Your Content. We do not claim any ownership rights to Your Content.

b. License to Kuha

By uploading Your Content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, display, reproduce, and modify (e.g., for resizing and creating thumbnails) Your Content on the Kuha platform, solely for the purpose of operating and providing the Service.

c. Prohibited Content

You agree not to upload any content that is illegal, defamatory, obscene, infringing on copyright or trademark, or otherwise violates these Terms or the rights of any third party.

d. Moderation

We reserve the right, but not the obligation, to remove any content and terminate any account, at our sole discretion, that we believe violates these Terms.

Our Service offers three types of paid products: one-time "Album Bundles," one-time "Add-On Purchases," and recurring "Partner Subscriptions." All payments are processed by our secure third-party payment processor, Paddle.

a. Album Bundles (One-Time Payment)

• Our "Host," "VIP," "Elite," and "Luxxe" tiers are offered as one-time purchases for a single album, referred to as "Album Bundles."
• Each Album Bundle grants a specific set of features, photo limits, and an expiration period for one (1) album.
• All fees for Album Bundles are paid in full at the time of creation and are non-refundable.

b. Add-On Purchases (One-Time Payment)

• From time to time, we may offer you the ability to make additional one-time purchases to enhance an existing album (e.g., "Add 1,000 more photos," "Extend expiration by 7 days").
• These "Add-Ons" are purchased on an as-needed basis.
• All fees for Add-On Purchases are paid in full at the time of purchase and are non-refundable.

c. Partner Subscription (Recurring Payment)

• The Partner Program is offered as a recurring subscription service.
• By signing up for the Partner Program, you agree to an initial and recurring subscription fee.
• Your subscription will automatically renew at the end of each billing cycle. You may cancel at any time, with the cancellation taking effect at the end of the current billing period. Fees for the current billing cycle are non-refundable.

d. Album Expiration and Deletion

When an album's expiration date (including any extensions purchased via Add-Ons) is reached, its status may be changed to "expired," making it inaccessible. We reserve the right to permanently delete expired albums and all associated content after a grace period of no less than 30 days from the expiration date.

Users who are part of our Partner Program ("Partners") are granted the ability to use custom branding and subdomains. Partners are solely responsible for the conduct of their clients and guests within the albums they create.

The Service and its original content (excluding UGC), features, and functionality are the exclusive property of Kuha.

We may terminate or suspend your account immediately, without prior notice, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will cease.

The Service is provided "AS IS" and "AS AVAILABLE". In no event shall Kuha be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service.

These Terms shall be governed by the laws of The Philippines, without regard to its conflict of law provisions.

We reserve the right to modify these Terms at any time. We will provide at least 30 days' notice of any significant changes.
